Greenburgh Plans To Put Frank's Nursery Land Up For Bid

GREENBURGH, N.Y. - The ongoing battle between two potential buyers and the Town of Greenburgh over the Frank's Nursery property hit yet another snag Thursday when Town Supervisor Paul Feiner proposed that the property be offered up for bids. Without benefit of a formal Request For Proposal (RFP) to offer the property for bids, the Town and Feiner considered offers from two groups - Game On 365 and Elm Street Sports Group. Game On offered $3 million in a deal and Elmsford Street Sports responded with an offer of $3.5 million. Feiner first accepted the Game On offer and Elmsford Street responded with threats to sue on the grounds that its offer was better at $500,000 more. Last week, House of Sports announced that Feiner and the Town had tentatively accepted its $3.5 million offer.

According to Feiner, Game On 365 may now challenge the potential deal with Elm Street and is considering the purchase of the golf range property adjacent to the Frank's Nursery property. Thursday, Feiner acknowledged that the possibility of litigation prompted a decision to put the property up for bid. The Town Board is scheduled to consider the RFP process in a work session Tuesday at 9: 30 a.m. "I think that the Town Board should consider issuing another RFP -request for proposals for the sales of Frank's nursery," Feiner said. If an RFP is issued the public will be able to compare the competing offers. And the property should be sold to the bidder who submits the best proposal for the town." Town of Greenburgh Supervisor candidate Bob Bernstein said in a press release Thursday that Feiner was “a day late and a million dollars short” in calling for a full-blown Request For Proposal. "Rather than do a proper RFP for the property back when the Town acquired Frank’s in a tax foreclosure tax in late 2010, Mr. Feiner instead engaged in a backroom attempt to lease the property to Game On,” Bernstein said. “What Paul did was wrong, wasteful, and a terrible disservice to taxpayers, who are on the hook for all the property taxes that must be paid on the property until it is sold and put back on the tax rolls.” Bernstein earned the backing of the Greenburgh Democrat Committee for the upcoming party nomination for Town Supervisor with a primary set for September 10. Feiner admitted that the previous negotiations with both potential buyers did not best serve the town and that open bids would offer a fair and competitive opportunity for all concerned. "If we issue another RFP we will be providing other developers who had not previously expressed interest in the property with an opportunity to bid to purchase the property,'" Feiner said in a statement. "Bids would be sealed and opened at a public forum. The town could set a minimum bid, require payment by a certain date. And limit the proposals for specific uses (such as recreation, residential) if we wish or encourage everyone who has an idea for the property to submit bids."
