On Friday, acting Wetschester County District Attorney James McCarty announced that Hasani Ewan, 39, has pleaded guilty to one charge of second-degree vehicular manslaughter after being arraigned on a seven-count indictment late last year.

Shortly after 1:30 a.m. on Sept. 7 last year, Ewan was driving eastbound on the Cross County Parkway near the Seminary Bridge in Yonkers with a female passenger when he suddenly drove off the highway into the bridge’s abutment.

The 2001 Honda Accord’s front passenger side impacted the bridge, killing Ewan’s passenger.

According to McCarty, “when police arrived, the defendant was outside the vehicle and appeared to be in an agitated state. Officers noted that Ewan’s eyes were glassy and that he staggered when he walked. They also detected the smell of alcohol on his breath and the smell of marijuana coming from his clothing.”

After being treated for a facial laceration at Westchetser Medical Center, Ewan was arrested and warned that he was under the suspicion of driving under the influence. Upon further investigation, Ewan was found to have a blood alcohol content level of .13 percent, nearly twice the legal limit.

Ewan was released on bail and is due back in court on Thursday, Aug. 11.

McCarty stated that he faces an indeterminate sentence of imprisonment having a maximum term of not less than three years and not more than seven years, and a minimum term of not less than one year and not more than one-third the maximum term. Thus, the least such sentence is one to three years, and the greatest such sentence is two and one-third to seven years in state prison.
